The experts of OLYMPEX ADVISERS successfully rendered services on representation and defense of the Client in appealing the environmental audit and administrative proceedings resulting from the environmental audit.

The essence of the disputed issues was to defend the legitimacy of the Client’s position on the charged violations of the environmental legislation: pollutant emissions without a permit and excess environmental emissions resulting in significant administrative fines, as well as potential risks of environmental damage and environmental emission charges.

In particular, the position was proven on invalidity of the audit certificate due to the lack of grounds for a repeat audit, conduct of the audit without registration of the audit appointment, violation of the terms of the audit and delivery of the audit certificate, on the merits of the violations – on availability of all permits, as well as on the lack of excess of the maximum permissible emissions, on incorrect calculations of pollutant emissions to determine the amount of administrative fines, etc.

As a result of the appeal, the administrative fines, potential risks of environmental damage and environmental emission charges were significantly reduced from 7.6 bln.tenge to 2.8 bln.tenge.
